Three UK: Connected Communities Nomination Terms & Conditions

These terms and conditions are the rules which apply to Three UK’s 5G Connected Communities Initiative nominations. By submitting an entry, nominators will be deemed to have read and agreed to be bound by them.

1. Promoter

The 3UK 5G Connected Communities Initiative (the “Promotion”) is organised by Hutchison 3G UK Limited (trading as Three), 450 Longwater Avenue, Green Park, Reading, Berkshire, RG30 3UR (“Three” or “We”). The successful nominee(s) will be entitled to the Package (as defined at paragraph 6 below) which is administered and fulfilled by Three.

2. Dates

The nominations open on 27/04/23 at 17:00 and close:

a) for Hull nominations at 23:59 on 19/05/23; and

b) for Liverpool and Manchester nominations at 23:59 on 20/06/23,

(each, a “Nomination Period”).

3. Eligibility

To be eligible to enter, nominees must be a youth club located in the regions of either Hull, Liverpool or Manchester (the “Regions”), within a Three 5G coverage area and whose members meet regularly in person, in a physical space (“Eligible Nominees”). Nominees may be required to provide evidence to prove their eligibility.

4. Nomination: How to

Any person can nominate an Eligible Nominee. To nominate, you must:

(i)          complete the Microsoft “Connected Communities” form with all details requested and press “submit”

(iii)        On completion of these steps, the Eligible Nominees will be entered during the Nomination Period (“Qualifying Entries”).

The details provided by the person completing the nomination form will be used to administer and fulfil this prize draw.  Do not submit any sensitive information or personal details of third parties without their full permission.

5. Rules

The following rules shall also apply to this Promotion:

a. Late entries will not be taken into consideration in selection.

b. Each Eligible Nominee must have in place suitable public liability insurance, have up to date health and safety risk assessments for their venue/activities, a Child Protection Policy in place and ensure that all leaders, whether paid or voluntary, have successfully completed a Disclosure and Barring Service (DBS) check exercise and hold a valid DBS certificate.

c. Each nominator warrants that all information submitted by them is true, accurate and complete and Three is not responsible for any information which is invalid or incomplete.

d. Three reserves the right to exclude and/or disqualify any entry which it deems, in its sole and absolute discretion: (i) to be inappropriate; (ii) fails to comply with these terms and conditions; and/or (iii) to be contrary to the spirit or intention of this Promotion.

6. Package

6.1        The “Package” is as follows:

(a)         one Fixed Wireless Access (FWA) unit;

(b)      network connectivity on an “as is” “as available basis for no charge on a temporary basis (approx. 2 years) via the FWA unit;

(c)      up to 10 tablets (the “Devices”); and

(d)      one “Discovery” session, led by representatives from Three, to support youth club members’ digital skills learning.

6.2        2 (two) Packages will be awarded per Region.

6.3        Please note: final award and provision of this Package will be dependent upon an assessment by Three (via its authorised technical specialists on a site visit, the “Three Tech Team”) of the quality of Three 5G coverage at the Eligible Nominee’s premises and written acceptance by the successful Eligible Nominee of the Package terms and conditions, which shall be provided to it for review post successful completion of this assessment. 

6.4      The successful Eligible Nominee shall be under no obligation to accept the Package once offered to it.

   Selection of successful Eligible Nominee(s)
   
   Selection shall occur as a two part process as follows:

Part 1

• initial selection shall be made randomly by a computer process from all Qualifying Entries. For the Hull Region, initial selection shall be made on or around 22^nd May 2023 and for Manchester and Liverpool, initial selection shall be made on or around 22^nd June 2023.

• the nominee(s) selected in this manner shall be contacted by a representative of Three using the details provided on the nomination form for Hull, on or around 25^th May and for Manchester and Liverpool, on or around week commencing 26^th Three shall not be liable for failure to contact this nominee due to any incorrect details provided on the nomination form.  The dates provided are for guidance and are indicative timescales only.

• upon contact, a suitable date shall be agreed between Three and the relevant nominee for the Three Tech Team to visit the relevant youth club premises to carry out a technical evaluation of the Three 5G coverage on site (by checking the level of coverage in each room).

Part 2

• The Three Tech Team shall then complete a report from this site visit and submit to the Corporate Communications Team at Three for review. Where, in Three’s sole discretion, the nominee is deemed to enjoy sufficient Three 5G coverage at their premises, Three shall contact them to offer them the Package subject to the Package terms and conditions.

The decision will be final and Three will not enter into any correspondence. 

8. Contacting the Nominees

8.1      Reasonable efforts will be made by Three to contact the randomly chosen Eligible Nominee(s) (for Part 1 of selection) via the contact details provided in the nomination form within 7 business days of the Promotion end date.

8.2      Three shall not be responsible in the event such a Eligible Nominee does not respond.

8.3      If a selected Eligible Nominee cannot be successfully contacted, or does not wish to accept the Package following completion of the assessment, or is unable to comply with these terms and conditions, Three reserves the right to offer the Package to another Eligible Nominee (who will be selected in the same manner described in paragraph 7). Failure to respond or failure to meet the eligibility requirements may result in forfeiture of the Package.

9. Redeeming the Package

9.1        The successful Eligible Nominee(s) shall be contacted via the contact details provided on the nomination form on completion of Part 2 of the selection process and shall be asked to respond to Three within the specified timeline to accept or decline the Package.  Further details on how the Package shall be fulfilled will be communicated upon acceptance by the successful Eligible Nominee.

9.2      The nominators and successful Eligible Nominees warrant that all information submitted by them is true, accurate and complete and Three is not responsible for any information which is invalid or incomplete, including any contact details. Three shall use reasonable endeavours, subject to these terms and conditions, to fulfil the Package as soon as reasonably possible after the winners have claimed it and confirmed their correct contact details.

10. Privacy

10.1     By entering a nomination you acknowledge and agree that you give and have full permission from any third parties to provide the details contained in the nomination form and that these will be used to contact a successful nominee. Please ensure you have the permission of any third parties prior to sharing their personal data as outlined above. Three shall use the personal data submitted in this nomination to administer and fulfil the Package in accordance with Three’s Privacy Policy (available at www.three.co.uk/privacy_safety/privacy_policies), and these terms.  

10.2     The successful Eligible Nominee(s) may be asked to participate in the filming of the Discovery session and post acceptance promotional activities, in which case this will be discussed and agreed prior to their acceptance of the Package.  It will be the responsibility of the Eligible Nominee to obtain relevant written consent from any participants (including in the case of any child under 16 parental consent) prior to their inclusion in these activities.

10.3    Three is required to publish or make available information to show that a valid award took place under this Promotion. To comply with this Three will confirm by email the name of the Eligible Nominee who becomes to beneficiary of the Package to any person who writes to: DLCorpComms@three.co.uk (Ref: Connected Communities) within one month of the Package being awarded.

11. General

11.1     The Package is not transferable or exchangeable. No cash alternatives will be offered. If the successful Eligible Nominee, once randomly selected, is not available or eligible for the whole or any part of the Package, for any reason, no alternative will be offered.

11.2    Three reserves the right at any time to substitute the whole or any part of the Package for an alternative of similar or greater value where circumstances beyond our control makes it necessary to do so. All costs and expenses not included in the Package are the responsibility of the successful Eligible Nominee.

11.3    Three reserves the right to amend these terms and conditions (including altering the Package) at any time without notice by updating these terms and conditions and publishing them at three.co.uk/terms.  No communications will be entered into by Three regarding this. No purchase is necessary to enter nominations, however an internet connection is required.

11.4     Three cannot accept responsibility for entries lost, corrupted, or delayed in transmission or for the failure by any Eligible Nominees to be successfully contacted. Under no circumstances will Three (or its parent, subsidiaries and affiliated companies) be liable (unless such liability cannot be lawfully excluded) for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in the Promotion or the Package (or any aspects of them), and Three excludes liability, to the fullest extent permitted by law, for any loss or damage caused to a successfully nominee arising out of or connected to the Promotion or this Package. Statutory rights are not affected.

11.5    Entry of nominations and acceptance of the Package by the successful Eligible Nominee signifies your/their acceptance of these terms and conditions. These terms are governed by English law.
